Andrew Stearns is a native of San Jose and has spent much of his career in litigation. He brings the lessons learned in litigation to counsel his clients on risk management, early resolution options and pre-litigation strategy. The majority of his practice is in the counseling and defense of automobile dealers and members of the construction industry in litigation. 

His representation of automobile dealers includes litigation of disputes with consumers, vendors and lenders involving claims for unfair business practices, violation the Consumer Legal Remedies Act, violation of the Telephone Consumer Protection Act, misrepresentation, fraud, breach of contract, personal injury and employment issues. Evaluating existing policies and procedures of dealerships and being aware of the changes in the industry through his experience in litigation matters, Mr. Stearns is able to counsel his clients in compliance matters and risk management in order to avoid litigation.

Mr. Stearns’ experience representing members of the construction industry includes the drafting and review of Prime Contracts, Subcontracts and Construction Manager Contracts, and advising clients on all facets of risk management in the construction trade. Having spent years in insurance defense firms, he is aware of the insurance needs for his clients and the use of insurance to avoid unnecessary defense costs to his clients which should be covered through applicable insurance and the indemnity provisions set forth in the contracts that govern the parties’ relationship. Acting as general counsel to several contractors over his career has allowed him to gain the knowledge and familiarity with the industry to represent his clients from the beginning of a project to the end and to defend them from construction defect claims.

In addition to his legal practice, Mr. Stearns is very involved in his community. A member of Rotary International since 1996, he is currently a member of the Rotary Club of Los Gatos, having previously been a member of the San Jose Rotary Club and the Davis Sunrise Rotary Club. He is also an active member of St. Andrew’s Episcopal Church, Saratoga. He has two children and enjoys gardening, cooking and playing off road in his Jeep.
